The United States Citizenship and Immigration Services recently announced the waiver of the biometric services fee for Form I-539, Application to Extend/Change Nonimmigrant Status.
Starting October 1, we will waive the $85 fee for biometric services as part of the Form I-539 application process. You do not have to pay the fee if your application is postmarked on or after October 1. However, if you file your Form I-539 before October 1, you will still be scheduled for an appointment at the ASC and will have to appear for your appointment as scheduled. In most cases, after October 1, applicants will not be scheduled to take biometric services. However, if USCIS determines that biometrics are required, the applicant will receive a notification with appearance information for their biometric services appointment.
If you mistakenly submit the biometric services fee and do so separately from the Form I-539 fee, we will refund the biometric services fee and accept the Form I-539. If you mistakenly submit the biometric services fee payment and the payment is combined with the filing fee for the paper Form I-539, this is considered an incorrect filing and we will reject the Form I-539. If you mistakenly authorize a credit card payment that combines the biometric services fee with the application fee, we will accept the request and only charge the application fee.
The biometric services fee waiver will apply to all applicants who file their forms on or after October 1, including certain applicants who file Form I-539 to request an extension of stay or a change of status to nonimmigrant. H-4, L-2 or E for which USCIS had already suspended the biometric data requirement until September 30, 2023.
